1. Who we are
Welcome to Pops. These Terms of Service ("Terms") form a binding agreement between you ("you", "your") and Pops AI, Inc., a Delaware corporation with offices at 2261 Market Street, #4732, San Francisco, CA 94114, USA ("Pops", "we", "our", "us"). They cover your use of our website, mobile, web, and desktop apps, our APIs, and related services (collectively, the "Services").
By creating an account, clicking "I agree", or using the Services, you agree to these Terms and our Privacy Policy and Acceptable Use Policy (each incorporated by reference).
2. Your account
You must be at least 18 years old (or the age of majority in your jurisdiction) to create a Pops account. If you're using Pops on behalf of a company, you confirm you have authority to bind that company to these Terms.
You are responsible for keeping your login credentials secret and for all activity on your account. Notify us right away at support@thepopspodcast.com if you suspect unauthorized access.
3. Subscription & billing
Pops is offered as a paid subscription: $14.99/month (monthly plan) or $149/year (annual plan), each in U.S. dollars unless otherwise noted at signup. Applicable taxes may be added based on your billing address.
- Subscriptions renew automatically at the end of each billing period unless you cancel before renewal.
- Prices may change. We'll give you at least 30 days' notice of any price increase before it applies to your subscription.
- You authorize us (and our payment processors) to charge your chosen payment method for each billing cycle.
- If a charge fails, we may pause your access until the issue is resolved.
4. No free trial
Pops does not offer a free trial. Access to the Services requires an active paid subscription. You must provide a valid payment method at signup. Your subscription begins immediately upon successful payment.
If you are unsatisfied within the first 14 days of your initial paid charge, you may request a full refund under our money-back guarantee described in Section 5.
5. Cancellation & refunds
You can cancel any time from Settings → Billing in your account. Cancellation is effective at the end of your current billing period; you keep access until then.
14-day money-back guarantee. If you're unhappy in your first 14 days as a paid subscriber, email support@thepopspodcast.com and we'll refund 100% of your most recent charge. Refunds outside that window are at our discretion and generally aren't issued for partial months or unused time.
6. Acceptable use
You agree to comply with our Acceptable Use Policy. In short, don't use Pops to break the law, harm others, generate sexual content involving minors, generate non-consensual intimate imagery, infringe IP rights, deceive consumers, or attempt to bypass safety features. Detailed rules are in the AUP.
We may suspend or terminate accounts that violate the AUP, and we may report unlawful activity to authorities.
7. User content & outputs
Your inputs. "Inputs" are anything you submit to the Services (text prompts, images, audio, files). You keep all rights to your Inputs. You grant us a limited license to process Inputs as needed to provide the Services and route them to AI providers.
Outputs. "Outputs" are content the Services generate from your Inputs. As between you and Pops, you own the Outputs you generate, subject to: (a) the underlying model providers' terms (we summarize them in-product), (b) third-party rights (e.g., trademarks, likeness rights, music), and (c) your responsibility for the Outputs you publish or distribute.
Commercial use. Paid subscribers may use Outputs for commercial purposes worldwide, royalty-free, except where blocked by an underlying model's license. You are solely responsible for confirming that any Output is appropriate for your intended use.
No training on your data. We do not use your Inputs or Outputs to train foundation models. See our Privacy Policy for details.
8. Third-party AI providers
Pops integrates with third-party AI model providers (e.g., OpenAI, Anthropic, Google, Black Forest Labs, Runway, ElevenLabs, Suno, and others). When you use a model, your prompt is processed by that provider under its applicable terms and privacy practices, which we summarize in-product and link to in your account settings. Pops does not control, and is not responsible for, the availability, accuracy, or content of third-party services.
9. Intellectual property
The Pops platform — including software, design, brand, logos, and documentation — is owned by Pops AI, Inc. or our licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Services according to these Terms. We reserve all rights not expressly granted.
Names like "GPT", "Claude", "Gemini", "Veo", "Sora", "Flux", "Midjourney", "Suno", "ElevenLabs", "HeyGen", and similar marks are property of their respective owners and used here for identification only. Pops is independent and not endorsed by, affiliated with, or sponsored by these companies.
10. Privacy
Our Privacy Policy explains what we collect, how we use it, and your choices. By using Pops, you consent to the practices described there.
11. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that Outputs will be accurate, lawful, original, or fit for any specific purpose.
AI Outputs may be inaccurate, misleading, or biased. Don't rely on Outputs for medical, legal, financial, or other professional advice. Always verify before publishing or making decisions.
12. Limitation of liability
To the maximum extent permitted by law, neither Pops nor our suppliers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption arising out of or related to the Services.
Our total aggregate liability for any claim arising out of or relating to the Services is limited to the greater of (a) $100 USD or (b) the amount you paid us in the 12 months before the event giving rise to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless Pops, our affiliates, officers, employees, and partners from any claim, damage, or cost (including reasonable legal fees) arising from your Inputs, your Outputs, your use of the Services, or your violation of these Terms or the rights of another party.
14. Changes to these terms
We may update these Terms from time to time. If we make material changes, we'll notify you via email or in-product banner at least 14 days before they take effect. Continuing to use the Services after the effective date means you accept the updated Terms.
15. Termination
You may stop using Pops at any time. We may suspend or terminate your account if you violate these Terms, pose a risk to others, or if required by law. Sections that by their nature should survive (e.g., IP, disclaimers, limitations of liability, dispute resolution) will survive termination.
16. Governing law & disputes
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Subject to Section 17, exclusive venue for any dispute is the state and federal courts located in San Francisco County, California.
17. Arbitration & class waiver
To the extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by JAMS under its Comprehensive Arbitration Rules. The arbitration will be held in San Francisco, California, or, if you are a consumer, in the county of your residence. You and Pops each waive any right to a jury trial and to participate in a class or representative action. You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@thepopspodcast.com. Nothing in this section prevents either party from seeking injunctive relief in court for IP infringement.
